ST. CLOUD - A Stearns County jury has found an Albany man guilty Friday on two counts of second-degree murder in the death of his infant son. However, they found 34-year-old Robert Kaiser not guilty on the one count of first-degree murder.

The boy was brought to the Albany Hospital on August 27th, 2014 after he was having difficulty breathing and was suffering seizures. He was airlifted to Children's Hospital where he died days later.

The boy died of a traumatic brain injury, likely caused by shaking.

The jury found aggravating factors in the crime because of the vulnerability of the child and Kaiser's position of authority. Those aggravating factors mean Kaiser could be sentenced to up to 40 years in prison.

He'll be sentenced January 12th in Stearns County District Court.
